These Terms of Service ("Terms") govern your access to and use of the LUCIA platform operated by eSapiens LLC ("Company"). By accessing or using LUCIA, you agree to be bound by these Terms.
LUCIA is an AI-powered platform for private credit underwriting, portfolio monitoring, and loan operations. The platform provides tools for analyzing borrower data, generating credit reports, tracking loan performance, monitoring covenants, and automating billing operations.
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You agree to use LUCIA only for lawful business purposes related to private credit and lending operations. You may not:
Your data remains yours. You retain all rights, title, and interest in the data you upload to LUCIA. We claim no ownership over your borrower data, financial documents, reports, or any other content you create or upload.
You grant us a limited license to process your data solely for the purpose of providing the LUCIA service. This license terminates when you delete your account.
LUCIA generates reports, analyses, and recommendations using AI. While we strive for accuracy, AI-generated content should be reviewed by qualified professionals before being used for investment decisions, credit approvals, or regulatory filings. LUCIA is a tool to assist, not replace, professional judgment.
We aim to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or improvements that temporarily affect availability. We will provide reasonable notice for planned downtime.
Subscription fees are billed monthly or annually as specified in your plan. We will provide at least 30 days' notice before any price changes. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESAPIENS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF LUCIA. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
You agree to indemnify and hold harmless eSapiens LLC from any claims, damages, or expenses arising from your use of the platform, violation of these Terms, or infringement of any third party's rights.
Either party may terminate these Terms at any time. Upon termination, you may request export of your data within 30 days. After 30 days, we may delete your data in accordance with our retention policy.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.
